Workshop Participation & Waiver of Liability Agreement

Thank you for participating in An Everyday Mystic and JenLandis.co’s retreat or workshop. These terms and conditions apply to all companies, and/or persons that are attending any workshop. Please ensure you have read and understand the following:

Workshop Participation & Waiver of Liability Agreement

Please read and understand the following terms and conditions:

1. Acceptance of Terms

By registering for the workshop, you agree to these terms and conditions.

2. Payment

The registration fee must be paid in full at the time of registration. Payment can be made through our merchant account.

3. Refunds

Tickets are non-refundable if less than 7 days before the event. If you cannot attend, you may send a substitute by emailing shaun@aneverydaymystic.com.
If you cancel within 2 weeks before the event you will receive a refund of 50% minus processing and administration fees (10%) and if you cancel within 3 weeks or more you will receive a full refund, minus processing and administration fees.

4. Cancellation

If, due to unforeseen circumstances, we need to cancel the workshop, you will receive a refund within 60 days, minus processing fees, if applicable.

5. Postponement or Venue Change

If the workshop is postponed for more than 6 months or moved to a location more than 60 miles away, you can cancel your ticket for a refund minus relevant processing fees by emailing shaun@aneverydaymystic.com.

6. Liability and Disclaimer

You release and indemnify An Everyday Mystic, its facilitators, contractors, volunteers, and affiliates from any and all claims, demands, and or liability for injuries, damages, losses, or claims in any way arising from, or related to, your participation in this workshop.

You understand that An Everyday Mystic is not responsible for lost or damaged personal belongings.

In case of an emergency, you authorize the organizers to seek medical attention on your behalf if deemed, in their sole determination, necessary. You understand that you are solely responsible for payment of any medical expenses incurred.

We do not provide medical advice. Please consult your physician or other medical professional, if needed.

Any stories or testimonials presented before or during the Workshop do not constitute a warranty, guarantee, or prediction regarding your experience during or after the Workshop.

You understand that your participation in the Workshop is not intended to create nor does it establish a client-practitioner relationship or any other type of therapeutic or professional relationship between you and the Teachers.

7. Your Obligations

• Comply with health and safety policies.
• Do not cause harm or nuisance.
• Do not bring hazardous items.
• You are responsible for any damage you cause at the venue or to others, and you are responsible for any loss or damage to your personal belongings.

If you act in any way which, in our sole opinion, is likely to cause any harm or nuisance to any person at the Retreat/Workshop, you will be required to leave the Retreat/Workshop and we shall not be liable to refund your Registration Fee or any other payment.

8. Promotional Materials

We may use your likeness from videos or photos in our social media, marketing or website content. You may use workshop materials for your personal purposes only.

9. Photography and Filming

We may photograph or film the workshop for promotional purposes. If you do not consent to this, please indicate at the bottom or the form. Otherwise, by attending, you consent to being photographed or filmed.

10. Data Protection

We will communicate with you using the contact details provided on the Registration Form for the purposes of the Workshop. You agree that we may send your personal data to software platforms used in our business (for example to the providers of our CRM system). We will not sell your information. We shall be entitled to pass on all of your contact details to the workshop contractors.

11. Tickets No physical tickets will be sent. Your name will be on the attendee list.

12. Travel, Accommodation, and Refreshments

You are responsible for your own travel. Accommodation will be assigned at the venue – there will be group sleeping arrangements. Limited private rooms are available at an upgraded cost if desired and available.

13. Special Requirements

If you have any special requirements, please email shaun@aneverydaymystic.com at least 2 weeks prior to the workshop.

14. Limitations of Liability

While every reasonable precaution is taken by us to ensure security and safety at the workshop, we shall not in any way be liable for any loss or damage suffered by you whatsoever in relation to the Workshop, save that nothing in these Terms shall be deemed to limit the liability of any person for death or personal injury caused by gross negligence.

Our total liability is limited to the price paid for the workshop.

15. Governing Law and Arbitration

These terms are governed by the United States and Nebraska state law. Should there be a dispute that arises, of any nature or kind, you agree to first mediate the dispute, with each party paying one half of the cost, and then to binding arbitration using the American Arbitration Association.

Nature of the Workshop

• The workshop is for personal growth and is not medical or psychological advice.
• You take full responsibility for your well-being during and after the workshop.
• Any stories or testimonials do not guarantee any particular outcome.

Waiver of Liability

• Participation is voluntary and at your own risk.
• You release An Everyday Mystic, JenLandis.co, the Teachers, volunteers, and contractors from any liability.
• In case of an emergency, we may seek medical attention for you.

THIS CONTRACT CONTAINS AN ARBITRATION PROVISION WHICH MAY BE ENFORCED BY THE PARTIES.
